1. General

These Terms & Conditions ("Terms") apply to your use of fastmvp.nl and to any proposals, offers, and services provided by FastMVP ("we", "us", or "our"). By using our website or engaging us as a client, you agree to these Terms. If you do not agree, please do not use this website or our services.

2. Services

FastMVP provides digital marketing, design, and related services, which may include:

• Strategy and positioning.
• Website, funnel, and landing page design and build.
• Performance marketing, growth campaigns, and analytics.
• Content, creative, and brand assets.

The exact scope of work, deliverables, and timelines are defined in a separate proposal or statement of work agreed with each client.

3. Proposals, fees, and payment

All proposals and fees are quoted exclusive of VAT unless stated otherwise. Payment terms will be specified in the proposal or invoice, typically requiring payment within a fixed number of days after invoice date.

• We may request an upfront deposit or milestone‑based payments.
• Late payments may result in suspension of work and/or additional charges as permitted by applicable law.
• All prices and proposals are subject to change until accepted in writing.

4. Client responsibilities

To deliver good work on time, we rely on collaboration from the client. You agree to:

• Provide accurate and complete information, assets, and feedback in a timely manner.
• Ensure that any materials you supply (such as logos, images, copy, or data) do not infringe the rights of third parties.
• Obtain any necessary approvals or internal sign‑offs promptly.

5. Intellectual property

Unless explicitly agreed otherwise in writing:

• You retain ownership of any original materials you provide to us.
• Upon full payment of all fees due, you receive a licence to use the final deliverables we create for you for the agreed purposes.
• We may retain ownership of our underlying methods, frameworks, and reusable components, and may re‑use them in other projects as long as no confidential information is disclosed.

6. Portfolio and marketing use

Unless you explicitly object in writing, we may reference your name, logo, and non‑confidential aspects of the work we did for you in our portfolio, case studies, and marketing materials (for example on fastmvp.nl or in pitch decks).

7. Confidentiality

Both parties agree to keep confidential any non‑public information received from the other party in the context of the collaboration, and to use it only for the purposes of delivering or receiving the agreed services, unless disclosure is required by law or consented to in writing.

8. Limitation of liability

We aim to deliver high‑quality work, but certain risks cannot be completely excluded. To the extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages (such as loss of profit, loss of data, or reputational damage).
• Our total liability in connection with any project is limited to the total fees paid to us for that project.

9. Use of the website

When using fastmvp.nl, you agree not to:

• Use the website for unlawful or harmful purposes.
• Attempt to gain unauthorised access to our systems or disrupt the website’s operation.
• Copy or re‑use substantial parts of the website content without our permission.

10. Termination

Either party may terminate an engagement if the other party materially breaches these Terms and does not remedy the breach within a reasonable period after written notice. Upon termination, you remain responsible for payment of all work completed and agreed expenses up to the termination date.

11. Governing law

These Terms are governed by the laws of the Netherlands (without regard to conflict of law provisions). Any disputes arising out of or in connection with these Terms will be submitted to the competent courts in the Netherlands.

12. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our services or legal requirements. The latest version will always be available on fastmvp.nl, with the date of the last update at the top of the page. By continuing to use the website or our services after changes take effect, you agree to the updated Terms.
